The client does not have to pay upfront fees or cover the lawyer's costs if the case is lost.However, if he wins, he will pay a "success fee", although this can be no more than 25 per cent of the damages awarded.The rules have encouraged a迷你倉沙田"have-a-go" culture, which has led to many spurious legal claims. For instance, the number of claims for whiplash following a car accident has risen by 25 per cent in the past four years, despite the number of road traffic accidents falling.The claimant may have to cover the defendant's legal costs, should he lose the case.
