The Court of Appeal has ruled that the Communications Authority must deal with PCCW's complaint that its customers cannot use the 4G network on the iPhone 5 because of a SIM lock.儲存 Launched in September last year, Apple's iPhone 5 is installed with a SIM- lock device that does not allow access to the PCCW 4G/LTE network. Originally, only SmarTone's 4G/LTE network could be accessed on the phone, though this was later extended to CSL and Hutchison. Access to PCCW's network remains denied. PCCW unit Hong Kong Telecom complained to the Office of the Communications Authority on September 28 last year, asking that it issue immediate directi迷你倉ns under the Telecommunications Ordinance to Apple and SmarTone to unlock the device. But in January, the authority replied that the information provided was inadequate to enable an assessment of whether the complaint raises a genuine competition issue. HKT then filed a notice of appeal to the authority's Appeal Board against the ``decision'' and in particular its ``refusal'' to issue immediate directions under the ordinance. But the Appeal Board chairman concluded that it had no jurisdiction to hear the appeal. The Court of Appeal concluded there is indeed jurisdiction on the part of the Appeal Board to hear HKT's case.
